Bu de\u011fi\u015fiklikler hem daha \u00f6nce m\u00fclk sat\u0131n alm\u0131\u015f bireyleri hem de gelecekte sat\u0131n almay\u0131 planlayanlar\u0131 etkiler. Bu makale, yeni yasan\u0131n temel h\u00fck\u00fcmlerini a\u00e7\u0131klayacak ve <strong><a href=\"https:\/\/northern-cyprus-property.com\/tr\/\">Kuzey K\u0131br\u0131s emlak <\/a><\/strong>hukukuna ve bunun emlak al\u0131c\u0131lar\u0131n\u0131 nas\u0131l etkiledi\u011fine odaklanacakt\u0131r.  <\/p>\n<hr>\n<h3>1. <strong>Mevcut M\u00fclk Sahipleri \u0130\u00e7in De\u011fi\u015fiklikler<\/strong><\/h3>\n<p>Kuzey <a href=\"https:\/\/selectestatesinternational.com\/\" target=\"_blank\" rel=\"noopener\">K\u0131br\u0131s&#8217;ta zaten m\u00fclk<\/a> sat\u0131n ald\u0131ysan\u0131z ancak baz\u0131 prosed\u00fcrleri tamamlamad\u0131ysan\u0131z, yeni yasa harekete ge\u00e7menizi zorunlu k\u0131l\u0131yor. \u0130\u015fte bilmeniz gerekenler: <\/p>\n<h4><strong>A. Sat\u0131\u015f S\u00f6zle\u015fmenizi Kaydetmek<\/strong><\/h4>\n<p>Yasa kabul edilmeden \u00f6nce <strong>Sat\u0131\u015f S\u00f6zle\u015fmesi<\/strong> imzalayan ancak hen\u00fcz <strong>Arazi Sicili&#8217;ne<\/strong> s\u00f6zle\u015fme kaydettirmemi\u015f yabanc\u0131 al\u0131c\u0131lar, bunu 21 May\u0131s 2024&#8217;ten <strong>itibaren alt\u0131 ay<\/strong> i\u00e7inde yapmal\u0131d\u0131r. Bu s\u00fcre i\u00e7inde kay\u0131t yapt\u0131rmazsan\u0131z, sat\u0131c\u0131 <strong>asgari \u00fccretin 500 kat\u0131na<\/strong> kadar para paras\u0131 alabilir. <\/p>\n<ul>\n<li>M\u00fclk\u00fcn\u00fcz\u00fc May\u0131s 2008&#8217;den sonra g\u00fcvenilir bir temsilci (bizim gibi) \u00fczerinden sat\u0131n ald\u0131ysan\u0131z, s\u00f6zle\u015fmeniz muhtemelen zaten kaydedilmi\u015ftir ve hi\u00e7bir \u015fey yapman\u0131za gerek yoktur.<\/li>\n<li>May\u0131s 2008&#8217;den \u00f6nce sat\u0131n ald\u0131ysan\u0131z ve s\u00f6zle\u015fmenizi hi\u00e7 kaydetmediyseniz, herhangi bir cezadan ka\u00e7\u0131nmak i\u00e7in \u015fimdi kaydetmelisiniz.<\/li>\n<\/ul>\n<h4><strong>B. Sat\u0131n alma \u0130zni Ba\u015fvurusu<\/strong><\/h4>\n<p>Yabanc\u0131 al\u0131c\u0131lar ayr\u0131ca \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131&#8217;ndan <strong>sat\u0131n alma izni<\/strong> almak zorundad\u0131r. Hen\u00fcz ba\u015fvurmad\u0131ysan\u0131z, yeni yasadan <strong>itibaren alt\u0131 ay<\/strong> i\u00e7inde ba\u015fvurmal\u0131s\u0131n\u0131z. Zaman\u0131nda ba\u015fvurmamak para cezas\u0131na yol a\u00e7abilir.  <\/p>\n<ul>\n<li>Bu izni al\u0131p almad\u0131\u011f\u0131n\u0131zdan emin de\u011filseniz, ba\u015fvurunuzun son tarihten \u00f6nce g\u00f6nderildi\u011finden emin olmak i\u00e7in l\u00fctfen bizimle ileti\u015fime ge\u00e7in.<\/li>\n<\/ul>\n<h4><strong>C. M\u00fclkiyetin Kesinle\u015ftirilmesi (Tapu Devri)<\/strong><\/h4>\n<p>Izin ba\u015fvurusunda bulunan ve onay bekleyen yabanc\u0131 al\u0131c\u0131lar, izin ald\u0131ktan <strong>sonra alt\u0131 ay<\/strong> i\u00e7inde m\u00fclkiyet devrini tamamlamal\u0131d\u0131r. \u00d6demeler veya m\u00fclk belgeleriyle ilgili sorunlar varsa, alt\u0131 ayl\u0131k d\u00f6nem ancak son \u00f6deme yap\u0131ld\u0131ktan sonra ba\u015flar. Transferin zaman\u0131nda tamamlanmamas\u0131, sat\u0131n alma izninin ge\u00e7ersiz kalmas\u0131na ve para cezas\u0131 verilmesine neden olabilir.  <\/p>\n<hr>\n<h3>2. <strong>Birden fazla m\u00fclk\u00fcn\u00fcz varsa ne olur?<\/strong><\/h3>\n<p>Yasan\u0131n izin verdi\u011finden daha fazla m\u00fclke sahipseniz, <strong>alt\u0131 ay<\/strong> i\u00e7inde Bakanl\u0131\u011fa bildirmeli ve \u00fccret \u00f6demelisiniz. Onlara zaman\u0131nda bildirmezseniz, \u00fccret artar. B\u00f6ylece fazladan m\u00fclkleri kendi ad\u0131n\u0131za devretmek <strong>i\u00e7in 24 ay\u0131n\u0131z<\/strong> var. Uyumsuzluk s\u00f6zle\u015fmelerinizi ge\u00e7ersiz k\u0131lar ve para cezas\u0131 al\u0131nabilir.   <\/p>\n<hr>\n<h3>3. <strong>Kuzey K\u0131br\u0131s&#8217;ta Yeni Gayrimenkul Al\u0131c\u0131lar\u0131 \u0130\u00e7in De\u011fi\u015fiklikler<\/strong><\/h3>\n<p>Yeni <strong>Kuzey K\u0131br\u0131s emlak yasas\u0131<\/strong> , gelecekte gayrimenkul sat\u0131n almay\u0131 d\u00fc\u015f\u00fcnenleri de etkiliyorum. \u0130\u015fte bilmeniz gereken temel de\u011fi\u015fiklikler: <\/p>\n<h4><strong>A. M\u00fclk Boyutu ve T\u00fcr\u00fc K\u0131s\u0131tlamalar\u0131<\/strong><\/h4>\n<p>Yabanc\u0131 al\u0131c\u0131lar yeni yasa kapsam\u0131nda yaln\u0131zca belirli t\u00fcr m\u00fclkleri sat\u0131n alabilirler:<\/p>\n<ul>\n<li><strong>Bo\u015f Arazi<\/strong>: Bir arsa, <strong>1338m\u00b2<\/strong>&#8216;ye kadar.<\/li>\n<li><strong>Daire<\/strong>: Bir daire (veya T\u00fcrkiye T\u00fcrk Cumhuriyeti vatanda\u015flar\u0131 i\u00e7in en fazla \u00fc\u00e7 daire).<\/li>\n<li><strong>Ev<\/strong>: <strong>3300m\u00b2<\/strong>&#8216;ye kadar bir arsa olan bir ev.<\/li>\n<\/ul>\n<p>Yabanc\u0131lar\u0131n tar\u0131m veya ormanc\u0131l\u0131k arazisi sat\u0131n almas\u0131na <strong>izin verilmez<\/strong> .<\/p>\n<h4><strong>B. Payla\u015f\u0131lan Tapu Belgeleri<\/strong><\/h4>\n<p>Vatanda\u015f olmayanlar art\u0131k <strong>ortak tapu<\/strong> ile m\u00fclk sat\u0131n alamaz. Bir m\u00fclk sat\u0131n almay\u0131 d\u00fc\u015f\u00fcn\u00fcyorsan\u0131z, <strong>bireysel tapu<\/strong> veya <strong>katl\u0131 bir tapu<\/strong> (T\u00fcrk\u00e7e&#8217;de &#8220;Kat \u0130rtifak Ko\u00e7an\u0131&#8221; olarak bilinir) olmal\u0131. Ortak tapu olan m\u00fclkler i\u00e7in yap\u0131lan herhangi bir s\u00f6zle\u015fme ge\u00e7ersiz olacakt\u0131r.  <\/p>\n<h4><strong>C. Yeni Geli\u015fmelerde Sat\u0131\u015flar<\/strong><\/h4>\n<p>Yeni projeler i\u00e7in ise <strong>\u00fcnitelerin en az %20&#8217;si<\/strong> <strong>KKTC vatanda\u015flar\u0131na<\/strong> veya <strong>T\u00fcrkiye Cumhuriyeti vatanda\u015flar\u0131na<\/strong> sat\u0131lmal\u0131d\u0131r. Ayr\u0131ca, <strong>birimlerin yar\u0131s\u0131ndan<\/strong> fazlas\u0131 birinci derece akrabalara veya ayn\u0131 vatanda\u015fl\u0131ktan yabanc\u0131 al\u0131c\u0131lara sat\u0131lamaz. <\/p>\n<h4><strong>D. Arazi Sat\u0131\u015f\u0131 S\u0131n\u0131rlamalar\u0131<\/strong><\/h4>\n<p>Herhangi bir b\u00f6lgedeki arazinin <strong>%7&#8217;sinden<\/strong> fazla ya da \u00fclke tamam\u0131ndaki <strong>topraklar\u0131n %3&#8217;\u00fc<\/strong> yabanc\u0131 al\u0131c\u0131lara sat\u0131lamaz. Bu, vatanda\u015f olmayanlar\u0131n sat\u0131n alabilece\u011fi arazi miktar\u0131nda s\u0131n\u0131rlamalar oldu\u011fu anlam\u0131na gelir. <\/p>\n<h4><strong>E. Ulusal G\u00fcvenlik Endi\u015feleri<\/strong><\/h4>\n<p>\u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131, <strong>ulusal g\u00fcvenlik nedenleriyle<\/strong> belirli b\u00f6lgelerde m\u00fclk al\u0131mlar\u0131n\u0131 k\u0131s\u0131tlayan d\u00fczenlemeler \u00e7\u0131karabilir. Bu k\u0131s\u0131tlamalar, yabanc\u0131 al\u0131c\u0131lar\u0131n belirli b\u00f6lgelerde m\u00fclk sat\u0131n almas\u0131n\u0131 engelleyebilir. <\/p>\n<h4><strong>F. Yabanc\u0131lara Ait \u015eirketler<\/strong><\/h4>\n<p>Daha <strong>\u00f6nce,<\/strong> yerel \u015firketlerin (\u00e7o\u011funlu\u011fu KKTC vatanda\u015flar\u0131na ait olanlar) serbest\u00e7e m\u00fclk sat\u0131n alabiliyordu. Yeni yasaya g\u00f6re, <strong>yabanc\u0131 m\u00fclkiyete<\/strong> veya yabanc\u0131 kontrol\u00fcndeki oy kullanma hakk\u0131na sahip \u015firketler <strong>yabanc\u0131 \u015firketler<\/strong> olarak kabul edilecek. Bu \u015firketler, bireysel yabanc\u0131 al\u0131c\u0131larla ayn\u0131 m\u00fclk k\u0131s\u0131tlamalar\u0131na tabi olacakt\u0131r.  <\/p>\n<h4><strong>G. Sat\u0131\u015f S\u00f6zle\u015fmelerinin Kayd\u0131<\/strong><\/h4>\n<p>Yeni m\u00fclk sat\u0131n alma s\u00f6zle\u015fmeleri <strong>75 g\u00fcn<\/strong> i\u00e7inde <strong>Arazi Sicili&#8217;nde<\/strong> kaydedilmelidir. Bu ad\u0131m\u0131 tamamlamazsan\u0131z, s\u00f6zle\u015fme ge\u00e7ersiz say\u0131l\u0131r. <\/p>\n<hr>\n<h3>4. <strong>G\u00fcven Anla\u015fmalar\u0131 ve Etkileri<\/strong><\/h3>\n<p>Yeni yasaya g\u00f6re, <strong>vatanda\u015f olmayanlar\u0131n<\/strong> m\u00fclkiyet k\u0131s\u0131tlamalar\u0131n\u0131 a\u015fmak i\u00e7in <strong>g\u00fcven anla\u015fmalar\u0131n\u0131<\/strong> kullanmalar\u0131na art\u0131k izin verilmiyor. Yasa kabul edilmeden \u00f6nce bir g\u00fcven s\u00f6zle\u015fmesi yapt\u0131ysan\u0131z, s\u00f6zle\u015fmeyi <strong>75 g\u00fcn<\/strong> i\u00e7inde <strong>Arazi Sicili&#8217;ne<\/strong> <strong>kaydetmelisiniz<\/strong>. Bunu yapmazsan\u0131z, anla\u015fma ge\u00e7ersiz hale gelir ve hem al\u0131c\u0131 hem de sat\u0131c\u0131 para cezas\u0131yla kar\u015f\u0131la\u015fabilir.  <\/p>\n<hr>\n<h3>5. <strong>Uyumsuzlu\u011fun Sonu\u00e7lar\u0131<\/strong><\/h3>\n<p>Yeni yasalara uymazsan\u0131z, ciddi cezalarla kar\u015f\u0131la\u015fabilirsiniz. Bu \u015funlar\u0131 i\u00e7erir: <\/p>\n<ul>\n<li>S\u00f6zle\u015fmenizi kaydettirmemek veya tapu devrini tamamlamamak i\u00e7in <strong>br\u00fct ayl\u0131k asgari \u00fccretin 500 kat\u0131na<\/strong> kadar para cezas\u0131.<\/li>\n<li>M\u00fclk i\u015fleminiz, gerekli s\u00fcre i\u00e7inde kaydedilmezse <strong>ge\u00e7ersiz<\/strong> hale gelebilir.<\/li>\n<li>M\u00fclkiyet s\u0131n\u0131rlar\u0131na uymamak veya g\u00fcven s\u00f6zle\u015fmelerini kullanarak yasalar\u0131 a\u015fmak cezai cezalara yol a\u00e7abilir.<\/li>\n<\/ul>\n<hr>\n<h3>Sonu\u00e7: Bilgilendirici Kal ve H\u0131zl\u0131 Hareket Et<\/h3>\n<p>Yeni <strong>Kuzey K\u0131br\u0131s emlak yasas\u0131<\/strong> , \u00f6zellikle yabanc\u0131 al\u0131c\u0131lar i\u00e7in b\u00f6lgedeki gayrimenkul al\u0131mlar\u0131nda \u00f6nemli de\u011fi\u015fiklikler getiriyor. Zaten m\u00fclk sat\u0131n alm\u0131\u015f olun ya da gelecekte sat\u0131n almay\u0131 planl\u0131yor olun, yasal sorunlar ve cezalardan ka\u00e7\u0131nmak i\u00e7in bu yeni kurallar\u0131 anlamak \u00e7ok \u00f6nemlidir. <\/p>\n<p>S\u00f6zle\u015fmenizi kaydetmek, sat\u0131n alma izni ba\u015fvurusu yapmak veya tapu devrini tamamlamak i\u00e7in yard\u0131ma ihtiyac\u0131n\u0131z varsa, bizimle ileti\u015fime ge\u00e7mekten \u00e7ekinmeyin.
